2. Scope of Application

These Terms of Service apply to all orders placed through our online shop. By placing an order, you agree to be bound by these terms.

We only sell to consumers. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business, or profession.

3. Contract Conclusion

The presentation of products in our online shop does not constitute a legally binding offer but an invitation to place an order.

By clicking the order button, you submit a binding offer to purchase the items in your shopping cart. We will confirm receipt of your order immediately via email.

The contract is concluded when we send you a shipping confirmation or deliver the goods.

4. Prices and Payment

All prices listed in our shop are final prices including applicable VAT. Shipping costs are displayed separately before you complete your order.

We accept the following payment methods:

  • Shopify Payments

5. Shipping and Delivery

We ship within the European Union and Switzerland. Delivery times are typically 4-8 business days from dispatch.

Please note that all items are printed on demand after your order is placed. This ensures the highest quality but means production takes a few extra days.

You will receive a shipping confirmation email with tracking information once your order has been dispatched.

6. Right of Withdrawal

As a consumer within the EU, you have the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period expires 14 days from the day on which you (or a third party indicated by you) acquire physical possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision by a clear statement (e.g., by email to info@nashe-shop.com).

Note: The right of withdrawal does not apply to goods made to customer specifications or clearly personalized.

7. Returns and Exchanges

We offer a 14-day exchange service for items in their original condition. Items must be unworn, unwashed, and with all original tags attached.

To initiate a return or exchange, please contact us at info@nashe-shop.com with your order number.

Return shipping costs are the responsibility of the customer unless the item is defective or we made an error.

8. Warranty and Defects

Statutory warranty rights apply. If your item arrives damaged or defective, please contact us immediately with photos and your order number.

We will provide a free replacement for any confirmed manufacturing defects.

9. Intellectual Property

All content on this website, including designs, logos, images, and text, is the property of NASHE and is protected by copyright law. Unauthorized use, reproduction, or distribution is strictly prohibited.

10. Liability

We are liable without limitation for damages caused intentionally or through gross negligence. For slight negligence, we are only liable for breaches of essential contractual obligations, limited to foreseeable, typical damages. This does not affect liability for personal injury.

11. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board.

12. Applicable Law and Jurisdiction

Austrian law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in the EU, you also benefit from the mandatory consumer protection provisions of your country of residence.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
